2. Terms & Conditions — Coaching & Consulting

Terms & Conditions
These Terms govern all coaching, consulting, and related services provided by Kimpact - Triple Impact LLC.

1. Parties

These Terms are between:

Kimpact - Triple Impact LLC (the “Provider”)
and
You (the “Client”).

2. Nature of Services

Coaching and consulting services are:

• Professional guidance
   
• Developmental support
   
• Educational in nature

They are not therapy, medical treatment, or legal advice.

3. Client Responsibilities

The Client agrees to:

• Participate actively
   
• Be honest and open
   
• Attend scheduled sessions on time
   
• Complete exercises when assigned
   
• Make decisions and take actions at their own discretion
   

The Provider is not responsible for decisions made or results achieved by the Client.

4. Fees & Payments

• Fees are communicated before purchase
   
• Payment is due before sessions unless otherwise agreed
   
• Installment options may be offered
   
• Invoices are issued by Kimpact Triple Impact LLC (Delaware)

Unpaid sessions may be cancelled.

5. Rescheduling

• Sessions can be rescheduled up to 24 hours in advance
   
• Less than 24 hours = session counted as used
   
• Emergencies will be handled with flexibility
   

6. Confidentiality

All sessions are confidential.
We do not share your content except when:

• Required by law
   
• You give written consent
   
• Safety concerns arise
   

7. No Guarantees

Coaching provides tools and support, but the Provider cannot guarantee:

• Specific personal outcomes 
• Business success
• Emotional or financial results

The Client is responsible for implementing insights.

8. Intellectual Property

All materials provided (PDFs, videos, frameworks, worksheets) remain the property of Kimpact - Triple Impact LLC.
They may not be distributed or reproduced without permission.

9. Liability

To the fullest extent permitted by law:

• The Provider is not liable for indirect or consequential damages
   
• Total liability is limited to the amount paid by the Client
   

10. Governing Law

These Terms are governed by:

• For EU clients: EU consumer protection law + Delaware company law
   
• For business clients: Delaware law unless otherwise agreed
   

11. Termination

Either party may terminate the coaching relationship with written notice.
Used sessions are non-refundable (see policy below).

 3. Refund & Cancellation Policy (EU-Friendly)

Refund & Cancellation Policy

1. Coaching Sessions

• Single sessions: non-refundable once delivered
   
• Packages: refundable only for unused sessions
   
• Used sessions are considered completed and cannot be refunded
   

2. Digital Products / Downloads

Under EU law, digital products are non-refundable once downloaded or accessed.

3. Programmes / Courses

Refund rules depend on the structure:

• Live group programmes:
  Refund possible up to 7 days before programme start
   
• Self-guided programmes:
  Refund possible before access is granted
  No refund after access is delivered
   

4. Cancellations by the Provider

If the Provider cancels a session or programme:

• A new date will be offered
   
• Or a full refund for the missed element
   

5. Consumer Rights (EU)

EU consumers normally have a 14-day withdrawal period, BUT:

Coaching and digital services begin immediately after purchase.

Thus, by purchasing, the Client agrees:

• Service starts before the withdrawal period ends
   
• They lose the right to withdraw once service begins
   

This is standard under EU Directive 2011/83/EU.
